General terms and conditions
1. General points
Helvetica Brands SA will sell goods, as specified in its catalog, online shop, or in written offers, to business/private customers (hereinafter “Customer”) under the terms and conditions of delivery and sale (T&Cs) presented below.
2. Conclusion of the contract
The contract between the Customer and Helvetica Brands SA will only be concluded following the placement of an order by the Customer and acceptance of this order by Helvetica Brands SA. Helvetica Brands SA will send the Customer an automatically generated order confirmation. With it, Helvetica Brands SA confirms that the order has been recorded.
3. Product offering
All details that the Customer receives in relation to the goods within the context of the order process are non-binding. In particular, these details are subject to changes to the design and technology of the goods to improve their functionality, as well as to errors in descriptions, pictures, and prices. Helvetica Brands SA makes every effort to thoroughly update availability information and ensure accuracy. However, accuracy is not guaranteed and information may be subject to change without prior notice.
4. Payment conditions
All prices are non-binding and constantly updated to reflect the current market prices. The prices are final which include value-added tax for customers. Additional expenses will be applied to online orders under CHF / EUR / USD 100.-. Every order has to be paid by credit card, PayPal or advance payment.
5. Delivery conditions
The ordered products can only be shipped to an address in the following countries. Provided they are in stock, the products will be dispatched immediately to the address indicated by the Customer after receipt of the payment. Otherwise, written confirmation of the order will be issued with an indication of the expected delivery date. The goods will be delivered (ex loading ramp) at the Customer’s expense and risk, even in cases where part deliveries are made. The delivery times are those applied by La Poste for Switzerland and by the selected carrier for all other countries. In the event that there is visible external damage to the ordered goods, claims will only be settled against presentation of confirmation from the carrier concerned. Delivery may be canceled if the product is no longer manufactured or delivered, resulting in the cancellation of the contract.

7. Retention of title
The delivered goods remain the property of Helvetica Brands SA until payment has been received in full. Helvetica Brands SA will be authorized to make a corresponding entry in the retention of title register. If the Customer is in default with regard to the payment of the purchase price, Helvetica Brands SA will be authorized to withdraw from the contract (by means of a notice of withdrawal) and take back possession of the goods.
8. Right to return goods
Helvetica Brands SA offers a right to return goods with due consideration for the following conditions: A period of 30 days applies to returns. This takes effect from the moment the buyer receives the goods. The goods must be returned in their original packaging, which must be unopened and in perfect condition (it must not be damaged, written on or glued). The costs of the return delivery will be borne by the buyer. If the above conditions are not met, Helvetica Brands SA may refuse to take the goods back. Any expenses incurred as a result of the buyer’s failure to return the goods in the proper manner may be charged to the buyer. If the buyer has returned the goods properly and in time, he will receive a credit note from Helvetica Brands SA. The right to return goods does not apply to specific customer manufactured goods or especially bought for the client.
9. Warranty for defects and liability
The warranty conditions apply to all products sold from the date of purchase according to indications given in every line of product. Defective products will be repaired or replaced free of charge during the warranty period. If it is no longer possible to repair or replace a product, it will be exchanged for an equivalent successor product. Helvetica Brands SA is unable to loan out devices while repairs are being carried out. The warranties exclusively cover material and/or manufacturing defects and therefore do not apply to consumables that are subject to normal wear and tear. Helvetica Brands SA is authorized to draw up chargeable cost estimates for repair orders that do not fall under the warranty conditions. The warranty will lapse if the Customer has modified or repaired the goods without the written consent of Helvetica Brands SA. In particular, Helvetica Brands SA will not be liable for damage that can be attributed to improper use or natural wear and tear or for damage that does not affect the delivered item itself (consequential loss due to defect). The Customer is responsible for backing up any data that may be present. Under no circumstances will Helvetica Brands SA be liable for the possible loss of data. Shipping costs will be borne by the sender.
10. Intellectual property
Helvetica Brands SA, representing SWITZ Licensing SA, a 100% affiliate of Helvetica Brands and the exclusive licensee/owner of the trademarks, reserves all rights,all designs, texts and graphics on its website. Copying, or otherwise reproducing, the entire website or parts thereof is only permitted for the purpose of placing an order with Helvetica Brands SA. The name Helvetica Brands SA, all page headings, navigation bars, graphics and icons are registered trade marks or brands of Helvetica Brands SA. All other trade marks, product names or company names/logos that feature on this website are the exclusive property of the relevant rightsholders. Helvetica Brands SA reserves the rights of ownership and copyrights to pictures, drawings, calculations and other documents. The Customer must obtain the explicit written consent of Helvetica Brands SA before passing these on to third parties.
11. Data protection
Helvetica Brands SA gives its assurance that the provisions of the Swiss Data Protection Act and the relevant legal norms will be observed during the collection, processing and use of personal data. Customer data acquired during the processing of the order will only be used for the purposes of settling the transaction. This data will only be passed on to partner companies to ensure the proper provision of the service (order processing). The Customer declares that he agrees to his data being used in this way.
12. Place of jurisdiction and applicable law
These terms and conditions and the contracts concluded on the basis thereof will be governed by Swiss law. The place of jurisdiction will be Porrentruy (Canton of Jura).
13. Final provisions
When goods specified in Helvetica Brands SA’s catalog and online shop are sold, the version of the terms and conditions that is valid at the time the relevant contract is concluded will apply exclusively. These terms and conditions will also apply in particular if they differ from those of the Customer. Should individual provisions of these T&Cs be or become invalid, this will not affect the legal validity of the other provisions. Helvetica Brands SA reserves the right to make changes to these General Terms and Conditions at any time.
