GENERAL PROVISIONS

Ateliers du Jura SA (hereinafter “Ateliers du Jura”) is responsible for the SWIZA® brand in connection with the manufacture and distribution of pocket knives. The company is registered under VAT number CHE-256.912.411 and has its registered office in Delémont (JU), Switzerland.

Ateliers du Jura sells products to companies, retailers and distributors (hereinafter referred to as the “Customer”) in accordance with these General Terms and Conditions of Sale and Delivery (hereinafter the “Terms and Conditions”).

These Terms and Conditions may be amended from time to time. The version applicable shall be the version in force at the time the order is placed.

TERMS OF USE

In order to place an order, personal data must be provided. It is the Customer’s responsibility to provide complete and accurate information. In the event of an error, the Customer should promptly contact Ateliers du Jura at info@ateliersdujura.com or +41 32 625 19 04.

The website may occasionally be unavailable due to maintenance or temporary technical issues. Orders are deemed confirmed upon receipt of the order confirmation. If the order confirmation is not received by email within 15 minutes of placing the order, please contact Ateliers du Jura at info@ateliersdujura.com or +41 32 625 19 04.

PURCHASING PROCESS

SWIZA® products displayed on the Website are offered subject to availability. Ateliers du Jura reserves the right to modify the range of products offered on the Website at any time.

The Customer may add the products of their choice to their shopping cart. Once the product selection has been completed, the Customer must provide the personal information required to process the order. Once the selection has been confirmed, the Customer will be invited to select a payment method.

CONCLUSION OF A CONTRACT

An order placed by the Customer via the swiza.com Website or by email constitutes a binding offer to enter into a sales contract with Ateliers du Jura. Ateliers du Jura shall only be bound by this offer once it has expressly accepted the order and sent the Customer written confirmation of the order by email.

Orders are considered accepted once Ateliers du Jura has confirmed receipt by email.

By placing an order, the Customer confirms that they are over 18 years of age and legally entitled to purchase pocket knives. Placing an order constitutes acceptance of these Terms and Conditions.

Ateliers du Jura cannot be held liable for indirect damages, such as loss of data. In all cases, Ateliers du Jura’s liability is limited to the amount of the Customer’s order.

Ateliers du Jura reserves the right to refuse any order from a Customer with whom a previous dispute exists or in the event of total or partial non-payment of a previous order.

PERSONALISATION AND ENGRAVING

SWIZA reserves the right to refuse any engraving request containing elements that:

  • are contrary to applicable law;
  • are offensive, insulting or discriminatory;
  • infringe the rights of third parties, in particular intellectual property rights.

Products personalised or engraved at the Customer’s request cannot be returned, exchanged or refunded, except in the event of a manufacturing defect or an error attributable to SWIZA.

OFFERS

The descriptions and illustrations of products on the SWIZA website, in catalogues or in written offers are provided for illustrative purposes only and do not constitute a guarantee that the products will be exactly identical in terms of colour, shape or size. SWIZA reserves the right to make design or technical modifications intended to improve the functionality of its products.

PRICES

Prices for SWIZA products are stated in Swiss francs (CHF) and include VAT and delivery costs. Prices displayed on the SWIZA website or in written offers are valid only for the period during which they are displayed or stated. Prices may be changed at any time without prior notice. The price applicable to an order is the price in force at the time the order is confirmed.

TERMS OF SALE AND PAYMENT

Payment must be made before delivery and may be made by credit card, PayPal or TWINT. Ateliers du Jura reserves the right to refuse certain payment methods.

DELIVERY TERMS

Delivery is available in Switzerland, Liechtenstein and most European countries, including Germany, Belgium, Denmark, Spain, Finland, France, Italy, Luxembourg, Malta, the Netherlands, Poland, Portugal, Slovenia and Sweden. Addresses deliberately entered for other countries in an attempt to circumvent the data entry system will neither be shipped to nor refunded.

If the products are in stock, they will be dispatched immediately to the address provided by the Customer. If the products are not in stock, Ateliers du Jura will inform the Customer in writing of the expected delivery date. Delivery times are indicative and may vary depending on circumstances. Ateliers du Jura cannot be held liable for delivery delays attributable to third parties (carriers, customs authorities, etc.). If a product is no longer manufactured or can no longer be delivered, the order will be cancelled and refunded. The refund will be made using the same payment method used by the Customer for the original payment. The delivered goods remain the property of Ateliers du Jura until payment has been made in full.

The Customer must inspect the condition of the products upon receipt of the order and report any irregularities to the carrier and the Seller as soon as possible.

RIGHT OF RETURN

The Customer has 14 days from the date of purchase to return the product. To qualify for a refund, the product must be in perfect condition, unused, undamaged and in its original, intact packaging. Only products ordered via swiza.com may be returned. The Customer is responsible for the cost of returning the product. Ateliers du Jura will issue the refund using the payment method originally used by the Customer only after the returned product has been received and inspected.

Knives may also be returned to our shop in Delémont free of charge.

The Customer may contact sav@swiza.com for information regarding the return procedure.

Please note that this return policy is in addition to your statutory rights as a consumer. We reserve the right to refuse a return if the conditions set out above are not met.

WARRANTY

LEGACIES Collection

For any damage relating to models from the LEGACIES collection, please contact us by telephone at +41 32 625 19 04 or by email at sav@swiza.com. Proof of purchase and photographs will be required in order to open an after-sales service case.

Pocket Knives

Ateliers du Jura cannot be held liable for damage caused by improper use, normal wear and tear, or indirect or consequential damage resulting from a defect. Shipping costs are borne by the sender.

The bodies of SWIZA® knives (the part comprising the blades and tools) are covered by a lifetime warranty.

Under certain conditions, the scales (the parts covering the body of the knife) may also be covered under warranty for two years following the purchase of the knife. The following conditions must be met:

  • The scales have not come into contact with abrasive chemical agents such as acetone.
  • The scales have not been burned or melted.
  • Claims must be accompanied by proof of purchase stating the date, supplier’s name and place of purchase (or website address), as well as photographs illustrating the defect or issue.
  • The claim must be submitted by email to sav@swiza.com.

Any request to replace defective plastic scales that is not covered by the warranty will be charged at CHF 5.–.

Any request to replace plastic scales with wooden scales will be charged at CHF 19.–, regardless of whether the knife is still under warranty.

Damage caused by unusual, improper or excessive use is not covered by the warranty. The same applies to damage resulting from the disassembly, modification or customisation of our products. Shipping costs are borne by the Customer.

Please note that counterfeit knives are not covered by the warranty.

Luggage

Luggage products are covered by a three-year warranty from the date of purchase. In the event of a defect during this period, we will give preference to replacing the product. If the product is no longer available, we will refund the equivalent value of your purchase in the form of a voucher to be used on swiza.com.

Damage caused by improper handling, particularly during transportation in checked baggage, is not covered by the warranty.

INTELLECTUAL PROPERTY

Ateliers du Jura is the holder of the licences and trademarks associated with its website and internal documents. All designs, texts and graphics published on the Website are the intellectual property of Ateliers du Jura, and their reproduction, in whole or in part, is prohibited. Ateliers du Jura holds the copyright and proprietary rights to illustrations, drawings, calculations and other documents. Any disclosure of these documents to third parties is subject to the prior written approval of Ateliers du Jura, which may be contacted at marketing@swiza.com.

Links on this Website to other websites are provided for informational purposes and to facilitate navigation. We accept no responsibility for the availability of external websites or resources to which links are provided. The content available on these external websites does not belong to us, and we disclaim any liability or warranty in relation to such content.

DATA PROTECTION

Ateliers du Jura ensures compliance with the provisions of Swiss data protection law and with the applicable legal standards governing the collection, processing and use of personal data. Customer data collected during the ordering process is used to carry out and process purchases. Such information may only be disclosed to partner companies where this is necessary for the provision of the relevant service and the processing of the order. The Customer agrees to this use of their personal data.

We endeavour to provide accurate and up-to-date information on this Website but cannot guarantee the accuracy, completeness or relevance of such information. The information provided on this Website is provided “as is”, without any express or implied warranty.

APPLICABLE LAW AND JURISDICTION

The contract is available in the language selected by the Customer when browsing the Website. However, although these Terms and Conditions are available in other languages, the French version shall prevail.

Ateliers du Jura has its registered office in Delémont, in the Swiss Canton of Jura.

These Terms and Conditions and any contracts concluded on the basis thereof are governed by Swiss law. The competent court shall be in Porrentruy (Canton of Jura), Switzerland.
